Job description


The Due Diligence Attorney is responsible for the review of title reports/title commitments and surveys pertaining to real estate transactions in order to identify and mitigate potential issues.  Representative title reviews include confirming ownership of the tower property by reviewing documents such as deeds, probate proceedings and heirship affidavits, and identifying potential adverse interests by reviewing documents such as mortgages, leases and easements.  Representative survey reviews include confirming the legal description of the tower compound area, as well as related easements, and ensuring the presence of adequate access from the tower compound to a public right of way and confirming the lack of encroachments.  The Attorney is also responsible for reviewing ground leases, easements and deeds for acquisitions, among other functions.


Job requirements


  • Review and analyze title commitments and title reports for legal risk
  • Review and analyze ALTA and as-built surveys and have a working knowledge of how to identify property using metes and bounds descriptions and sectional references
  • Develop and maintain a thorough knowledge of applicable state law with respect to common title issues, including but not limited to intestate law, statutes of limitations for liens, joint ownership and probate law   
  • Assist in resolving title curative issues, including but not limited to missing deeds, missing interests, missing memoranda of lease/assignments, utility and access easement issues, mortgages, liens, delinquent taxes, probate issues and improper or lack of signature authority
  • Work with internal customers and property owners to resolve title and survey issues
  • Work with external title and survey companies, as required, in accordance with departmental and company policy
  • Draft documents such as Assignments, Ingress, Egress, and Utility Easements, Subordination and Non-Disturbance Agreements and Not Me Affidavits
  • Ensure process efficiency and accurate and timely deliverables within provided cycle time goals
  • Conduct ground lease reviews for acquisitions
  • Work independently and manage workload in order to meet team and company goals 
  • Prepare legal analysis of and negotiate resolution of property owner transactions and customer requests relating to terminations, renewals and assignments
  • Coordinate with US Legal team members to resolve due diligence issues with property owners and customers

  • Attention to detail in the preparation and review of contracts and agreements; strong legal drafting skills
  • Strong computer skills; proficient with Microsoft Office Suite


  • JD and license to practice law (any state) required
  • 1-3 years experience, with title experience strongly preferred


100% performed in climate-controlled internal office environment working under normal office conditions.   Approximately 0-10% travel will be required in support of the position’s responsibilities.
